Reservation Rental Agreement

 

THE FRANCONIA NOTCH VACATIONS’ MISSION: To Provide a Trouble Free & Easy Enjoyable Franconia Notch & surrounding White Mountain Vacation Experience. To find that everything in your vacation property is in good order, that it is clean upon your arrival and that you have everything you need as described. So please, be sure to let us know if we can help with your Franconia Notch Vacation in any way!

RESERVATIONS AND PAYMENTS
Booking a Franconia Notch Vacations is easy. Browse our website, www.visitfranconianotch.com, any time of the day, any day of the week for photographs, descriptions & details- then book online. You can also reserve a property by calling 603.823.2112 at our Franconia office during office hours - 10:00 a.m. to 4:00 p.m. One person in your party must be responsible for payments, property damages and all responsibilities spelled out herein and in the rental contract; this designated person's primary residence address will be used for all notices and correspondence. After you make your reservation, we'll e-mail you a rental contract and your guest registration forms, at which time your reservation is confirmed whether made on-line or in person (cancellation fee will apply if cancelled after this point), regardless of our receiving the necessary signed documents and the advance payment. The advance payment is 50% of the total amount due. The total rate includes all applicable taxes, fees and a non-refundable reservation fee, which varies by property. Linens and towels are provided, and standard beds are made for your arrival. A limited supply of paper goods will also be included on arrival. Advance payments must be paid by check or e-check in USD, yet all reservations require that a valid Visa, Master or Discover credit card be on file. The advance payment is due with your signed rental contract and completed guest registration forms within 14 days of making the reservation. The remaining balance is due 7 days before and no later than the time of check-in and may be paid by check, e-check or credit card, (Visa, MasterCard & Discover accepted, additional processing fees may apply). If your paperwork and advance payment are not received within 14 days of booking, your reservation may be automatically cancelled. Please note: The returned check fee is $50 USD.

RESERVATIONS MADE FEWER THAN 30 DAYS BEFORE ARRIVAL
If your reservation is made fewer than 30 days prior to check-in, it must be paid in full at the time of booking – either by check, e-check or credit card, (Visa, MasterCard & Discover accepted, additional processing fees may apply)

CHOOSING YOUR VACATION RENTAL
Rental properties are individually owned and reflect the taste of the owners. They vary in size, decor and amenities; pictures and descriptions appear on our website. For rentals of four nights or longer, we'll be happy to show you up to three properties as long as they're not occupied and a Rental Agent is available to accompany you. Appointments are required. Please note: prospective guests will not be given keys to view properties un-accompanied.

HOUSE LOCATIONS AND QUALITY RATINGS
Locations of properties vary, yet all are within a 25 mile radius of Franconia Notch State Park. Rental Agents can answer specific questions regarding views or mountain trail access. Rustic: Rustic Class category of homes include our smaller, older or perhaps less equipped properties. You can expect to find a clean, fully functional vacation rental accommodation at the best price available. Low on frills, long on value. Deluxe: Deluxe Class category of homes offers all of the modern conveniences and comforts of a fully equipped Professionally Managed Vacation Rental home. Expect to find most every comfort thought of included, with some views to match. Relaxed White Mountain leisure is most assured in the Deluxe. Grand: The Grand Class of properties include Estate Property offerings which are generally quite large and long on comfort, offer outstanding views, are often steeped in White Mountain history, and frequently include the most modern elements of design. Grand Class homes include THE most exclusive Professionally Managed Vacation Rental offerings in the Franconia Notch region.

HOUSES and AMENITIES
All properties feature standard items starting with fully equipped kitchens to include microwave, coffee maker, toaster, pots and pans, dishes, utensils and glassware, and most with a BBQ grill. WiFi Interrnet (speeds vary by location), TVs with HDMI and/or SmartTV capabilities, (cable or satellite service vary by location), and central plumbing & heating.  Unique and specific equipment and-or amenities for each property are listed in the individual property description on the website. Jetted tubs, additional TVs, VCRs, DVDs, porch furniture, trail access, recreational games, equipment and similar items may be furnished as a courtesy by the owner and are not guaranteed. All equipment in each property has been inspected to be in working order when you check in. Please report any inoperative equipment or problems to the office immediately. You can expect a courteous and professional attitude to resolving any problem, and we will make every reasonable effort to do so promptly. Please understand that emergencies take precedence, and that trade professionals and resources are scattered & seasonal. Under no circumstances will there be a reduction of rent for any mechanical failure of refrigerators, dishwashers, washers, dryers, internet, cable or satellite TV failure, televisions, VCRs, DVD Players, hot tubs, swimming pools or any other appliances or amenities. High chairs, cribs and rollaway beds are available through Franconia Notch Vacation Rentals at 603.823.2112. Additional rental charges may apply.  NOTE: Every effort has been made to ensure the accuracy of the property information on our website; however, it is not guaranteed. All statements are subject to errors, omissions, change of price, change of property contents and/or features or withdrawal without notice.

MAINTENANCE AND EMERGENCIES
We have a dedicated yet limited group of maintenance support staff. They are available most every day of the week to take care of everything from plumbing problems to delivering a new toaster to you. If you have a problem or need something, we'd like you to call us immediately. When you check-in, you will receive our after-hours emergency ONLY telephone number. For non-emergency issues, please call the office during office hours.

LINENS
Sheets and towels are supplied and sufficient to accommodate the maximum capacity of the property. Standard beds will be made up with linens, blankets and a bedspread. Towels will be placed on beds. Everything will be ready for you to kick off your shoes and relax! Please be sure all linens stay in the property when you depart.

HOME SUPPLIES
Your Vacation Rental home will be professionally prepared for your arrival and will include a limited courtesy supply of paper goods such as paper towels, toilet paper, tissues, dish soap and trash bags.

WHAT TO BRING
Condiments and staples, coffee filters, plastic wrap and aluminum foil, bath soap, and shampoo. During summer months include sun block, bug spray, beach towels, and your favorite outdoor toys. In winter we suggest good warm footwear, gloves, a hat and of course, all of your favorite snow toys!

TELEPHONES, INTERNET ACCESS & MAIL
Telephones (land-line) are not available in every property. Personal cell phones should be in service for all the homes we serve using Verizon, AT&T & US Cellular service providers, all others may be questionable.  Most properties have Internet Connection with WiFi access, yet speed varies by location and conneciton type; be sure to ask the Rental Agent about any particular need then otherwise or search our website for a list.  If needing to advance ship or mail anything to your stay items may be sent to PO Box 605 and shipments to 287 Main Street, Franconia, NH 03580.  Please notifiy our office of any delivery you may expect to be sure we get it to you just as quickly as the shipping company does. Under no circumstances should guests contact the telephone or internet/cable providers for repairs or change of services. If this rule is violated, the guest is responsible for any and all charges.

HOLIDAYS AND PEAK SEASON RENTALS
The following peak season requires a three night minimum stay: July 4th Weekend to Labor Day Weekend. A five-night minimum stay is required for Christmas to New Year’s Day and February President’s Week Holiday rentals. During the summer Peak Season, some properties have a minimum seven-night stay requirement, and check-in days are most generally on Saturdays. For rentals of less than seven nights during Peak Season, check our website for Internet Specials and Summer Weekends for properties with weekend availability. Off-Peak seasons offer extra value.

ARRIVALS
Check-in time for all guests is between 4:00 p.m. or after; this allows our housekeeping staff time to prepare your vacation property properly. Please don't pressure our staff to let you into your property before 4:00 p.m., however do feel free to call our Franconia office to discover if an early arrival is possible. We are always happy to get you started earlier than 4pm if the property is properly prepared, however there's plenty to do should you need to wait til-- enjoy our rivers, tour the historical & art walk elements of Franconia or visit the village playground and explore the Gale River. On rare occasions it may be necessary to delay check-in beyond 4:00 p.m. Only the reservation holder is allowed to check in and receive lock-box keys codes. Sorry, few exceptions, talk to your leader.

DEPARTURES
Check-out time is 10:00 a.m. After leaving your Vacation Rental please resecure your keys in the same manor you recieved them and let us know how much fun you had during your stay with your Guest Review! We look forward to hosting you again and to any feedback that enables us to serve you, our guests better.  Don't forget to make your reservation for next season or year! During Mid and Low Seasons and for two-night rentals, check-out days and departure times may be more flexible based upon availability. Check with our office prior to departure to see if late check-out may be possible.

CHECK-IN DAYS
With the exception of holidays and Peak Season rentals, guests may arrive on any day. Our Direct to The House Arrival procedures will accommodate your arrival sure enough, though only the reservation holder or their informed designee is allowed to check in and receive keys codes. Sorry, no exceptions.

OCCUPANCY POLICY
A quiet atmosphere for the enjoyment of our guests and our Franconia Notch neighbors is paramount. We rent only to family groups and responsible adults over the age of 21. Any use of the property for purposes other than family vacations must be addressed at the time of the reservation. Occasions such as parties, weddings, receptions, company gatherings or picnics are generally not allowed. We do not rent to prom groups, school or graduation groups, fraternities or sororities or youth groups with or without adult supervision. Adults may not rent properties on behalf of underage guests. Guests must comply with these Rental Policies and all subdivision restrictions. In certain circumstances, a refundable security deposit will be required. Our website indicates the maximum number of guests allowed in each property. All guests and their vehicles must be listed on the Guest Registration form. Exceptions are made only for infants.

PARKING
To help preserve the quality of life on Franconia Notch area, subdivisions limit the number of cars which can be parked at properties. Most subdivisions allow four cars at each property, where at some it’s just two. Check with the Rental Agent about parking restrictions for your specific vacation property. RVs and campers are not permitted on the grounds of any property without prior written notice, and parking is not allowed on streets, or lawn areas.

PETS
Some properties are pet-friendly and allow two small dogs. Be sure to ask about these properties when you speak with the Rental Agent or you can search for pet-friendly properties on our website. There is a non-refundable pet fee of $100 per dog per week or $45 per weekend.

PROPERTY DAMAGES
Guests will not be responsible for the first $850.00 of accidental damage to the property or its contents caused by the Guest, the Guest's family or invited guests. However, the Guest will be responsible for any such accidental damages in excess of $850.00 and for all damage or loss to the vacation property and its contents that is not the result of accidental damage. Accidental damage is defined as unintentional damage from unforeseen accidents; it does not include loss or damage resulting from intentional acts, gross negligence, willful and wanton conduct or damage or loss caused by a pet or other animal brought onto the premises by the Guest, the Guest's family or invited guests. If damage occurs during your stay, be sure to call the office right away so that we can take care of it for you. Failure to notify the Franconia Notch Vacations office promptly will revoke ALL Accidental Damage Protection. Non-compliance with the rental contract, these rental policies, occupancy rules, subdivision restrictions, or pet restrictions, or any illegal activity or conduct creating a nuisance, waste, hazard or disturbance are each grounds for immediate eviction without refund.

CANCELLATIONS, REFUNDS & SUBSTITUTIONS
We understand that there can be unforeseen emergencies that could cause you to cancel your reservation. We'll try to work with you to resolve the situation. However, please note our cancellation policy: We do not give refunds for rainy days or overcast skies. We do not give refunds for power outages during or following severe storms. We strongly recommend that you take Trip Cancellation and Travel Interruption insurance - remember the Ice Storm of 1998! Information about Travel Insurance will be made available. If circumstances require, Franconia Notch Vacations reserves the right to substitute a comparable mountain property. If comparable accommodations are not available, then Guests may choose from available properties at the published rate or request a refund. No refunds are given for early departures. Power, cable and telephone outages occur occasionally in the White Mountains Region and they are out of our control. We will report the outages; however, no refunds will be given due to these outages. New construction is a part of life in the Franconia Notch area. If your property is near construction, we will do our best to talk with the contractors, but please realize that this situation is beyond our control. Sorry, no refunds or moves will be made under these circumstances. There is no refund for appliance, plumbing or mechanical failure, utility failure, or circumstances beyond our control. Once your reservation is made with confirmation number provided any cancellations, changes of dates or switching of properties will invoke the cancellation policy. Cancellations thirty or more days prior to date of arrival: a full refund will be issued, less the non-refundable Reservation Fee which varies by property, and Travel Insurance premium, if taken. Cancellations fewer than thirty days prior to date of arrival: a full refund will be issued, less the non-refundable Reservation Fee which varies by property, and Travel Insurance premium, if taken, ONLY if Franconia Notch Vacations is able to re-rent the property for the same time period. Refund checks will be issued within 30 days after cancellation. Once you have entered into a contract to rent a property, you are binding yourself to that property for that time. There should be no expectation of compensation or relocation because you don't like the property or something in the property isn't working to your satisfaction. Unlike a hotel, we cannot relocate you without specific authorization from the home owner. As previously stated, we will make every effort to correct any malfunctions or problems encountered, but no refunds should be expected. Franconia Notch Vacations reserves the right to cancel a confirmed reservation (with proper good reason) at any time prior to occupancy of the property. In the event this should occur, Franconia Notch Vacations will refund all monies on account.

LOST & FOUND
Franconia Notch Vacations is not responsible for items left behind in properties. We will attempt to locate lost items, but can’t guarantee that we will find them. Please check your property carefully before leaving. There is a $25.00 fee to search for and/or retrieve lost items, plus shipping fees. The fees will be either charged to your credit card or paid by money order. Retrieved items are kept at the office for 30 days; after 30 days, the items are donated to charity.

MISCELLANEOUS
Franconia Notch Vacation Rental & Realty, LLC., a New Hampshire corporation d/b/a Franconia Notch Vacations, is acting solely in the capacity as Real Estate rental agent acting on behalf of the owner. Each rental of a vacation home is at will and on a day-to-day basis, and each Guest agrees that only one days' notice to vacate is require, and that no notice to terminate the Guest's tenancy with respect to any vacation home is required. To the fullest extent allowed by law, each Guest waives any notice or other requirement that a "Landlord" is required to provide to a "Tenant" under New Hampshire Rental Property Codes. To be effective, any notice or request for disclosure by the Guest with respect to the rental of the vacation home or otherwise with respect to these matters must be in writing and delivered Franconia Notch Vacations at its office address. The rental of each vacation home is made with no implied warranties of merchantability, habitability, fitness for a particular purpose, or any other kind and each vacation home is rented in its present condition, "as is - with all faults". Subject to the prior provisions in these Rental Policies regarding accidental damage to the house and its contents, Guest shall indemnify, defend and hold harmless Franconia Notch Vacations and the owner of the house, their employees, agents and representatives, and all of their successors and assigns (together, the "covered parties), from and against any and all losses, claims, damages, liabilities, causes of action, costs and expenses (including reasonable attorneys' fees) for personal injury or property damage arising from or in connection with Guests right of access to the house and property, occupation or condition of the house and property and/or use of the house and property, and regardless of any negligence or strict liability on the part of any of the covered parties and regardless of the form of claim whether at common law, strict liability, negligence or under any statute or regulation. Franconia Notch Vacations does not discriminate with respect to the rental of vacation homes based on race, color, religion, sex, familial status, national origin or disability. These Rental Policies and the rental contract constitute the entire agreement regarding the rental of the vacation home and unless incorporated herein and therein, there are no oral representations, warranties, agreements or promises pertaining to the rental of the vacation home. All these matters shall be construed in accordance with the laws of the State of New Hampshire, and exclusive venue with respect thereto is in the State Courts of Grafton County, New Hampshire. The terms and provisions of these Rental Policies may be revised and amended at any time, and from time to time, by Franconia Notch Vacations, and if so revised and amended and furnished to the Guest prior to the Guest's occupancy of the vacation home, they shall for all purposes be considered effective and binding upon the Guest, as so revised and amended. Franconia Notch Vacations rental guidelines change from time to time. The most current version is found on our website, www.visitfranconianotch.com and is also provided to you along with your rental contract.
